Hall Prangle attorneys Marilee Clausing, Aaron Ryan, and Joe Muska recently secured a defense verdict in a Cook County trial on behalf of a minimally invasive gynecologist. The case centered on the death of a 67-year-old woman. Plaintiff claimed that the defendant doctor failed to either order tumor markers and serial ultrasounds for an ovarian cyst or to perform laparoscopic removal of the cyst, leading to a failure to diagnose ovarian cancer, which resulted in the patient’s death. The defense successfully argued that tumor markers or laparoscopic removal were not required by the standard of care, and that the only cause of the patient’s death was the patient’s high-grade serous carcinoma, which is an aggressive cancer often diagnosed only in late stages.
